1. Acceptance of Terms
By downloading, registering, accessing, or using the Airplays Connect mobile application or website (collectively, the "Platform"), you agree to be bound by these Terms of Service (the "Terms").
The Platform is owned and operated by Mano Media ("Company," "we," "our," or "us"). These Terms represent a legally binding agreement between you and Mano Media.
If you do not agree to all of these Terms, you are prohibited from using the Platform and must immediately discontinue use of our mobile applications and website.
2. Eligibility & Accounts
You must be at least 18 years of age to register an account or use our Platform. If you are under 18, you may only use the Platform under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms.
The Platform operates with role-based access:
- Artists: Register accounts in-app, upload audio tracks, submit music campaigns, browse professional listings, view campaign analytics, and exchange direct messages upon matches.
- Industry Professionals (DJs, curators, managers, A&Rs, etc.): Vetted and registered exclusively by Platform Administrators. You cannot self-onboard. You agree to provide accurate credentials and maintain professional standards when writing reviews.
- Administrators (Super Admin, Onboarding Admin): Manage settings, review withdrawal claims, approve professionals, and monitor platform compliance through the Next.js admin dashboard.
You are responsible for maintaining the confidentiality of your credentials. You agree to notify us immediately of any unauthorized access to your account.
3. Submissions & Dynamic Cost Structure
Airplays Connect connects independent artists with industry professionals via submission campaigns. We enforce a dynamic, balance-based credit and pricing system:
A. Dynamic Cost Setting
The cost per submission (the price to submit a track to one professional profile) is dynamic and configured by platform administrators. Submission costs may fluctuate over time based on currency values, demand, or campaign sizes.
B. Account Balance & Credit Guarantees
Artists purchase submission credits (or fund their wallet) using **Stripe** or **PawaPay**. When you buy credits at an active rate, those credits are locked. If the administrator adjusts the submission cost later, your existing credit balance remains valid at the exchange rate locked at the time of your deposit (ensuring you receive the number of submissions you originally paid for).
C. Campaign Batches
Artists configure campaigns by selecting a set number of professional profiles (subject to a minimum batch configuration set by administrators, such as 10 profiles). Once a campaign is paid and submitted, the transaction is locked in our database using a First-In, First-Out (FIFO) queue to freeze the platform split ratios and professional payout parameters at that exact moment.
D. No Refund Policy
Once a submission batch has been successfully processed and a professional completes the listen and review condition, the payment is fully earned. Submissions are non-refundable. If a professional fails to review your track within the platform’s active timeout period, the credit for that specific professional will be returned to your wallet balance automatically.
4. Professional Reviews & Earnings
Music industry professionals receive payouts for completing feedback on artist submissions. By accepting submissions, professionals agree to:
- Listen Validation: The Platform uses real-time listen tracking (monitoring active playback, pauses, and continuous heartbeats). Professionals must listen to the required duration of the track before writing feedback. Payouts will not trigger for skipped tracks.
- Feedback Quality: Feedback must meet our Quality Gate parameters. Reviews must be constructive, personalized, and specific to the track. AI-generated, generic ("good track, check mine out"), or copy-pasted reviews are flaggable and subject to withholding of payouts.
- Payout & Revenue Share: Professionals earn a dynamic share of the submission cost, which is logged at the time the artist purchases and submits the batch. Platforms split dynamic revenues (e.g. 40% platform, 60% professional) and lock payouts on submission.
- Withdrawals: Earned funds can be withdrawn through the professional account tab to mobile money (PawaPay) or standard bank deposits (primary withdrawal gateway configured by administrators), subject to minimum withdrawal limits and vetting.
5. Direct Messaging & Connection Policy
If a professional reviews a track and expresses genuine commercial or creative interest, they may trigger an Interested status signal.
When a professional marks a track as "Interested", a direct chat channel between the Artist and the Professional is automatically opened at no cost to either party. We do not charge fees to unlock messaging.
To prevent spam and abuse of the direct messaging feature, professionals are subject to monthly caps on the number of "Interested" signals they can issue. Users agree to communicate respectfully and professionally inside the app.
6. IP & Media Licensing
Artist Retains Ownership: You retain full copyright, master rights, and intellectual property rights in any music, lyrics, cover art, and media you upload to the Platform. Mano Media does not claim ownership of your creative content.
Platform License: By uploading audio files or metadata, you grant Mano Media a worldwide, non-exclusive, royalty-free, sub-licensable license to host, transcode, cache, stream, and distribute your content within the Platform solely to facilitate your campaigns (e.g. streaming the file to target professionals and admins).
Reviewer License: You grant selected music professionals a limited, non-exclusive license to listen to and review your track. Professionals are strictly prohibited from copying, distributing, broadcasting, remixing, or publicly playing tracks uploaded to the Platform without the artist's explicit written consent.
7. Prohibited Conduct
To protect our marketplace ecosystem, the following actions are strictly prohibited:
- Creating fake professional profiles or falsifying credentials/experience.
- Using bots, automated scripts, or external playback manipulations to bypass the listening validation gate.
- Submitting plagiarized, stolen, or copyrighted material without legal authorization from the rights holders.
- Harassing, abusing, or spamming other users inside the direct messaging threads.
- Circumventing platform rules to coordinate off-platform transactions in a fraudulent manner.
8. Disclaimers & Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. Mano Media makes no warranties, express or implied, regarding the services.
Airplays Connect guarantees that selected professionals will receive, listen to (for the verified minimum duration), and provide written reviews for your submitted tracks, or your credit is returned. However, we do not guarantee any commercial outcomes, record deals, radio plays, contract offers, or positive reviews. Feedback is subjective and up to the individual professional.
In no event shall Mano Media, its officers, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform.
9. Account Termination
We reserve the right to suspend or terminate your account and block access to the Platform at our sole discretion, without notice or liability, for reasons including:
- Material breach of these Terms of Service.
- Fraudulent payout manipulations or fake reviews.
- Explicit spamming or harassment of artists/professionals in chat threads.
- Requests by law enforcement or regulatory agencies.
You may terminate your account at any time. Account deletion clears your public identity, uploaded tracks, and profile data, subject to section 5 of our Privacy Policy.
10. Governing Law
These Terms of Service and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the country where Mano Media is registered, without giving effect to any choice of law rules.
You agree that any legal action or proceeding arising out of your use of the Platform will be brought exclusively in the courts of competent jurisdiction located in that region.
